Welcome to Thea Sculpt ("Thea Sculpt," "we," "our," or "us"). These Terms and Conditions govern the use of our website, services, appointments, consultations, body sculpting treatments, lymphatic drainage services, wellness services, and personal training services.

By booking an appointment, receiving services, using our website, or communicating with us regarding services, you agree to be bound by these Terms and Conditions.

LICENSE INFORMATION

Thea Sculpt operates under all applicable laws and regulations governing massage and wellness services in the State of New Jersey.

Services are provided by a licensed massage and bodywork therapist.

  1. SERVICES PROVIDED

Thea Sculpt provides non-medical wellness services including but not limited to:

• Lymphatic drainage massage
• Body sculpting treatments
• Wellness treatments
• Personal training services
• Fitness and wellness education

All services are intended for wellness, fitness, and aesthetic purposes only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  1. SCOPE OF PRACTICE

    Thea Sculpt provides wellness and bodywork services within the scope permitted by applicable New Jersey law and professional licensing requirements.

    Clients acknowledge that services provided by Thea Sculpt are not a substitute for medical diagnosis, treatment, physical therapy, chiropractic care, mental health treatment, or other licensed healthcare services. Clients requiring medical care should consult an appropriate healthcare provider.

  1. NO MEDICAL ADVICE

The information provided through our website, email communications, social media accounts, consultations, and services is for informational and educational purposes only.

Thea Sculpt does not provide medical advice, diagnosis, or treatment. Clients should consult a licensed physician or qualified healthcare provider regarding any medical concerns prior to receiving services.

  1. ELIGIBILITY

Clients must be at least eighteen (18) years old to receive services independently.

Clients under eighteen (18) years of age must:

• Have written parental or legal guardian consent
• Have all required intake and consent forms completed
• Be accompanied by a parent or legal guardian during services when required by Thea Sculpt

We reserve the right to refuse service to any individual who does not meet eligibility requirements.

  1. CLIENT SCREENING & APPOINTMENT APPROVAL

Thea Sculpt specializes in specific wellness and bodywork services and may not be the appropriate provider for every individual seeking treatment.

Submission of an appointment request does not guarantee acceptance as a client or confirmation of services. Appointment requests are reviewed based on treatment goals, health history, safety considerations, service suitability, provider expertise, availability, and other legitimate business considerations.

Thea Sculpt reserves the right to decline appointment requests for any lawful, non-discriminatory reason, including when services are determined to be outside the provider's scope of practice, expertise, or treatment focus.

Submission of an appointment request does not guarantee acceptance as a client or confirmation of services.

Thea Sculpt reserves the right to conduct an initial screening process to determine whether a prospective client is an appropriate candidate for the requested services. Appointment requests are subject to review based on health history, treatment suitability, safety considerations, service availability, and business policies.

Thea Sculpt reserves the right to decline appointment requests for any lawful, non-discriminatory reason, including when services are deemed inappropriate, contraindicated, outside the provider's scope of practice, or otherwise unsuitable for the prospective client.

  1. APPOINTMENTS

Services are provided strictly by appointment only.

Walk-in appointments are not accepted.

Appointment requests submitted through email, website forms, phone, or social media are not considered confirmed until approved by Thea Sculpt and any required deposit has been received.

  1. DEPOSITS

A $100 non-transferable deposit is required to secure all appointments unless otherwise stated.

Appointments are not guaranteed until the deposit has been received and confirmed.

  1. CANCELLATION AND RESCHEDULING POLICY

Clients must provide at least twenty-four (24) hours notice for cancellations or rescheduling requests.

Deposit Terms:

• Cancellation more than 24 hours before appointment: deposit refunded
• Cancellation within 24 hours of appointment: deposit forfeited
• Same-day cancellation: deposit forfeited
• No-show appointments: deposit forfeited
• Late arrivals requiring rescheduling: deposit forfeited

Thea Sculpt reserves the right to require a new deposit for future bookings following cancellations, no-shows, or repeated rescheduling requests.

  1. LATE ARRIVALS

Clients are expected to arrive on time.

• Arrivals 10–15 minutes late may result in a shortened session.
• Arrivals exceeding 15 minutes late may require rescheduling.
• Full service fees may still apply regardless of shortened treatment time.

  1. CLIENT HEALTH DISCLOSURE

Clients are responsible for fully disclosing all relevant medical conditions, medications, allergies, surgeries, injuries, and health concerns before receiving services.

Failure to provide complete and accurate information may result in:

• Immediate termination of service
• Forfeiture of deposits
• Refusal of future appointments
• Limitation of liability to the fullest extent permitted by law

  1. MEDICAL CONTRAINDICATIONS

Clients agree to disclose any condition including but not limited to:

• Pregnancy or breastfeeding
• Heart disease
• Pacemaker, defibrillator, or implanted medical devices
• Active cancer or cancer treatment
• Kidney disease
• Liver disease
• Lymphatic disorders
• Diabetes
• Hypertension
• Recent surgery
• Blood clotting disorders
• Use of blood-thinning medication
• Open wounds
• Skin infections
• Hernias
• Any condition affecting safe participation

Thea Sculpt reserves the absolute right to decline, modify, postpone, or discontinue services if treatment is deemed unsafe.

  1. CLIENT RESPONSIBILITIES

Clients agree to:

• Arrive adequately hydrated
• Follow all preparation instructions
• Wear appropriate clothing
• Inform the provider of discomfort during treatment
• Follow all aftercare recommendations

Failure to follow instructions may impact treatment outcomes and increase risk of adverse effects.

  1. POST-TREATMENT CARE

Clients agree to follow all post-care instructions provided by Thea Sculpt, including hydration, activity restrictions, and other recommendations.

Thea Sculpt is not responsible for outcomes resulting from failure to follow post-care instructions.

  1. RESULTS DISCLAIMER

Individual results vary significantly.

Thea Sculpt makes no guarantees regarding:

• Weight loss
• Body measurements
• Appearance
• Fitness performance
• Health improvements
• Treatment outcomes

Testimonials and photographs do not guarantee similar results.

  1. PERSONAL TRAINING RISKS

Participation in exercise, fitness instruction, stretching, strength training, cardiovascular training, and related activities involves inherent risks including but not limited to:

• Muscle strains
• Sprains
• Falls
• Dizziness
• Injury
• Aggravation of existing conditions

Clients voluntarily assume all risks associated with participation.

  1. REFUND POLICY

All sales are final.

No refunds will be issued for:

• Completed services
• Missed appointments
• Deposits
• Service packages
• Promotional offers

Packages are non-transferable and may only be used by the original purchaser.

Packages expire according to the terms disclosed at the time of purchase.

  1. HYGIENE REQUIREMENTS

Clients must arrive clean and free from lotions, oils, or substances that may interfere with treatment.

Thea Sculpt reserves the right to refuse service when hygiene conditions may compromise treatment safety or effectiveness.

  1. PHOTOGRAPHY AND DOCUMENTATION

Treatment documentation may include photographs for progress tracking and recordkeeping purposes.

No photographs will be used for marketing, advertising, testimonials, social media, or promotional purposes without separate written consent.

  1. RIGHT TO REFUSE SERVICE

Thea Sculpt reserves the right to refuse, terminate, or discontinue services at any time if:

• A client appears impaired by drugs or alcohol
• A client behaves inappropriately
• A client fails to disclose relevant health information
• A client creates safety concerns
• Treatment is deemed inappropriate or unsafe

  1. LIMITATION OF LIABILITY

To the fullest extent permitted under New Jersey law, Thea Sculpt, its owners, employees, independent contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from services provided.

Any liability shall be limited to the amount paid for the specific service giving rise to the claim.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or other liability that cannot legally be waived.

  1. INDEMNIFICATION

Clients agree to indemnify and hold harmless Thea Sculpt and its owners, employees, contractors, and affiliates from any claims, losses, damages, liabilities, costs, or expenses arising from:

• Breach of these Terms
• Failure to disclose health conditions
• Failure to follow instructions
• Misuse of services
• Participation in services

  1. WEBSITE USE

All website content, including logos, text, graphics, photographs, videos, branding, and educational materials, is the exclusive property of Thea Sculpt and may not be copied, reproduced, distributed, or used without written permission.

  1. ELECTRONIC COMMUNICATIONS

By contacting Thea Sculpt through email, text message, website forms, or social media, you consent to receiving communications regarding appointments, services, scheduling, and business operations through electronic means.

  1. FORCE MAJEURE

Thea Sculpt shall not be responsible for delays, cancellations, or inability to provide services due to circumstances beyond reasonable control, including weather events, emergencies, natural disasters, power outages, illness, governmental actions, or similar events.

  1. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted under the laws of the State of New Jersey.

  1. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

  1. CHANGES TO TERMS

Thea Sculpt reserves the right to modify these Terms and Conditions at any time. Updated versions will be posted on the website and become effective upon posting.
